    • Terms of Service

    • We, GOQii (collectively used to refer to GOQii Inc., GOQii Technologies Pvt. Ltd. and its affiliates, successors and assigns) bring to you a digital health and fitness subscription service that combines one-on-one mobile personal coaching and fitness tracking technology to help you shift to a healthier lifestyle and reach your goals.

      These Terms of Service along with the Privacy Policy govern your access to and use of the Services. By accessing and using any of the Services, you agree to be bound by these Terms. If you do not agree, please do not access or use the Services.

      We may revise these Terms at any time. We will notify you of any material changes via email or in-app notification at least 30 days before the revised Terms take effect. If you do not agree to the revised Terms, you must stop using the Services before they take effect.


    • Your Use of Services

      1. All users 13–17: parental permission required, parent/guardian bound by Terms;
      2. India DPDP Sec. 9: verifiable parental consent via consent flow before account activation, no tracking/profiling;
      3. USA COPPA: under-13 not permitted, COPPA deletion request process;
      4. EU GDPR Art. 8: country-specific age of digital consent (13–16); (e) All under-18: no advertising of any kind, all advertising permanently disabled.

      Once you purchase GOQii Services, you may learn more about the Services via information available on the Platform, including the FAQs available at https://goqiisupport.zendesk.com/hc/en-us. In order to register, you may be required to provide: full name, email address, account credentials (hashed password), gender, profile picture, contact details, address, date of birth, height, weight, dietary information, fitness and exercise details, medical history and conditions, and medication details. You are responsible for maintaining the accuracy and completeness of this information.

      You may register through your existing email accounts. Your email address constitutes your username. You are responsible for maintaining the confidentiality of your username and password.

      GOQii reserves the right to verify your age at registration and at any point during your use. Accounts found in breach of these age requirements will be suspended. Parents or guardians who become aware of an unauthorised minor account should contact privacy@goqii.com immediately.


    • Your Privacy Rights

    • Your personal data collected through your use of the Services is processed in accordance with our Privacy Policy (available at goqii.com/privacypolicy). Under applicable data protection law, including the Digital Personal Data Protection Act 2023, you have the right to access, correct, erase, and port your personal data; to withdraw consent; to nominate another individual to exercise your rights; and to raise grievances with our Grievance Officer. Please refer to our Privacy Policy for full details and contact information.


    • Connected Health Platforms — Apple Health and Google Fit / Health Connect

    • By connecting Apple Health, Google Fit, or Google Health Connect to GOQii, you:

      1. Grant GOQii permission to read and/or write specified health data types from those platforms (steps, heart rate, sleep, activity, body measurements, and related data) for the purpose of providing personalised coaching and wellness insights.
      2. Acknowledge Apple HealthKit restrictions: GOQii's use of data from Apple HealthKit is limited to health and fitness purposes described in our Privacy Policy. HealthKit data will NOT be used for advertising, sold to third parties, or used for any purpose not disclosed in our Privacy Policy. This is a binding requirement under Apple App Store Review Guidelines §5.1.3.
      3. Acknowledge Google Health Connect restrictions: GOQii's use of Google Health Connect data is limited to providing and improving health and fitness features. This data is not used for advertising or any purpose unrelated to health and fitness services, per the Google Health Connect Permission Policy.
      4. Understand you may disconnect at any time:
        Apple Health — iPhone Settings > Health > Data Access & Devices > GOQii
        Google Fit / Health Connect — Android Settings > Health Connect > App permissions > GOQii
        GOQii App — Settings > Privacy > Connected Platforms
      5. Understand data already imported is retained for 3 months after disconnection and then deleted, unless you request earlier deletion via privacy@goqii.com.
      6. Disconnecting a health platform stops future data sync but does not immediately delete data already imported. To request immediate deletion of all imported health platform data, use the data erasure request process described in our Privacy Policy.

      For users under 18, connecting Apple Health or Google Fit / Health Connect requires explicit parental or guardian consent in addition to the user's own consent. This can be provided via the parental consent flow at registration or via Settings > Privacy > Connected Platforms.


  • We Do Not Provide Medical Advice

    The Services provided by GOQii, including information provided through personalised coaching services, does not constitute medical advice of any kind. Nothing on the Platform should be construed as an attempt to offer or render a medical opinion, or otherwise engage in the practice of medicine. You should consult with your physician before making any changes to your diet or exercise programme. GOQii is not responsible for any medical or mental health problems you may face as a result of accessing or using the Services.

    HIPAA Notice for US Users: If you are a user in the United States and your health information constitutes Protected Health Information (PHI) under HIPAA, your PHI is handled in accordance with our HIPAA Notice of Privacy Practices, available by contacting privacy@goqii.com or by writing to our Grievance Officer. GOQii complies with applicable HIPAA requirements in its role as a business associate of covered entities where applicable.

    For users under 18: Parents and guardians should actively supervise their minor's use of the Services and consult a qualified medical professional before acting on any health recommendations made to their minor child through the platform. Coaching guidance provided to minor users is general wellness and fitness information only and is not a substitute for professional paediatric or adolescent medical care.


  • Modifications to Services and Data

    The Services may change over time as we add more features. We may modify, suspend or discontinue, temporarily or permanently, the Services (or a part of the Services) from time to time. If we intend to discontinue a material feature or the entire Service, we will provide at least 30 days' prior notice and maintain data export functionality throughout that period.

    You may export your personal data at any time via Settings > Privacy > Download My Data. GOQii takes reasonable steps to maintain data integrity and availability; however, we recommend maintaining your own copies of important health records.


  • User Content

    You are solely responsible for all information, data, text, photographs, and other materials (User Content) that you upload, transmit, or post on the Platform. You agree not to use the Services to post any content that is unlawful, threatening, spam, or that contains software viruses.

    General product feedback, feature suggestions, and non-personal comments you share with GOQii may be used by GOQii without obligation of confidentiality or compensation. However, any personal data, health data, or sensitive personal data you include in such communications remains subject to our Privacy Policy and applicable data protection law.

    You grant GOQii a non-exclusive, worldwide, royalty-free licence to use, copy, display, reproduce, modify, adapt, and distribute the User Content you post on the Platform solely for the purpose of operating, providing, and improving the Services. This licence terminates when you delete your User Content or close your account, except to the extent GOQii is required by law to retain it. GOQii will not use your health data or sensitive personal data in User Content for advertising or commercial profiling without your separate explicit consent.

    For users under 18: the licence granted to GOQii does not permit GOQii to use the personal data or health data of users under 18 for advertising, marketing, or commercial profiling, regardless of any general consent granted at registration.


  • Data Protection and DPDP Compliance

    GOQii Technologies Private Limited acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 (DPDP Act) in respect of personal data of Indian residents processed through the Services.

    Data Principal Rights and SLAs

    As a user of our Services, you are a Data Principal under the DPDP Act. Your rights and applicable response timeframes are:

    1. Right to Access: Request a copy of your personal data — response within 30 days.
    2. Right to Correction: Request correction of inaccurate data — actioned within 30 days.
    3. Right to Erasure: Request deletion of your personal data — completed within 30 days of consent withdrawal, subject to legal retention obligations.
    4. Right to Data Portability: Request your data in machine-readable format (JSON/CSV) via Settings > Privacy > Download My Data — fulfilled within 30 days.
    5. Right to Withdraw Consent: Withdraw consent for any consent-based processing, including Apple HealthKit and Google Health Connect data access, at any time via app Settings > Privacy > Manage Consent.
    6. Right to Nominate (DPDP Sec. 13): You may nominate another individual to exercise your data rights in the event of your death or incapacity. Submit nominee details in writing to grievance@goqii.com.
    7. Right to Grievance Redressal: Raise a grievance with our Grievance Officer and, if unresolved, escalate to the Data Protection Board of India.

    To exercise any right, email privacy@goqii.com or use in-app Settings > Privacy. We will respond within 30 days and provide written reasons if a request is denied.

    Data Retention and Deletion

    GOQii retains your personal data only as long as necessary for the purposes collected or as required by law. Key retention periods: user profile data — 3 months after account deletion; health and activity data — 3 months after account deletion or last activity; Apple HealthKit and Google Health Connect data — 3 months after account deletion or permission revocation; coach chats — 1 year; consent logs and audit trails — 7 years; support tickets — 2 years. Full retention schedule is available in our Privacy Policy at goqii.com/privacypolicy. For users under 18: personal data is deleted within 30 days of a parental/guardian deletion request or account closure, with no retention beyond strict necessity.

    Breach Notification

    In the event of a personal data breach likely to affect your rights, GOQii will:

    1. Where a breach affects users under 18, parents or guardians will be directly notified.
    2. notify the Data Protection Board of India (DPBI) as required under DPDP Sec. 17;
    3. notify CERT-In within 6 hours per CERT-In Directions 2022;
    4. notify the U.S. Department of Health and Human Services (HHS) where PHI is involved under HIPAA

    Health Data and Platform Integrations

    GOQii processes sensitive personal data including health and fitness information. Such data is processed only with your explicit, informed consent and for the purposes described in our Privacy Policy. For users under 18, health platform integrations require explicit parental or guardian consent in addition to the user's own consent. You may withdraw consent for any data processing, including health platform integrations, at any time via app Settings > Privacy > Manage Consent.

    Data Fiduciary Obligations

    GOQii implements appropriate technical and organisational security measures to protect your personal data, appoints a Grievance Officer as required by law, and will notify you and applicable regulatory authorities in the event of a personal data breach, in accordance with the DPDP Act and CERT-In Directions 2022.

    Children's Data

    Children's Data and Minor User Protections' with 6 bullet-point commitments:

    1. No advertising of any kind;
    2. No commercial data sharing;
    3. No profiling;
    4. HealthKit / Health Connect data for service delivery only;
    5. Parental deletion right — 30 days (5 days for COPPA/USA);
    6. Parental access right. Contact: privacy@goqii.com, subject 'Minor Account Request'.

  • Services Content

    The Services may contain content (data, text, audio, video, images) protected by copyright, patent, trademark, or other proprietary rights. All Services Content is owned exclusively by GOQii. You are granted a worldwide royalty-free licence to use the Service Content for personal and non-commercial use only. None of the Platform or Service Content may be republished, posted, stored, sold, distributed or modified without our prior written consent.


  • Third Party Content

    The Services may link to third-party sites and resources. GOQii is not responsible for third-party content or their privacy practices. Your use of third-party resources is subject to the terms of those third parties.


  • Doctor Policy

    GOQii Service connects you with GOQii Doctors (General Practitioners) to help and advise you on routine medical and lifestyle challenges. GOQii Health Service is not for medical care. No formal medical diagnosis, treatment, or prescriptions will be provided. Please see your doctor in person if you are looking for a personal medical evaluation, diagnosis, or prescription.


  • Indemnity

    You agree to defend, indemnify and hold harmless GOQii (including its affiliates, directors, employees and officers) from any losses, liabilities, damages, demands, costs or expenses (including reasonable attorneys' fees) arising out of or relating to any claim made by any third party due to or arising out of violation of these Terms of use of the Platform and/or Services.


  • Disclaimer of Warranties

    Your use of the Services is at your sole risk. The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law. We do not warrant that the Services will be uninterrupted or error-free.

    Nothing in this disclaimer excludes or limits:

    1. our liability for death or personal injury caused by our negligence;
    2. our liability for fraud or fraudulent misrepresentation;
    3. our obligations under applicable data protection law including the DPDP Act 2023 in relation to the security and handling of your personal data;
    4. any other liability that cannot be excluded or limited by applicable Indian law or the Consumer Protection Act 2019.

  • Limitation of Liability

    Subject to the exclusions stated in the Disclaimer of Warranties above, and to the extent permitted by applicable law, GOQii's total aggregate liability to you for all claims arising out of or related to these Terms or the Services will not exceed the greater of:

    1. the total subscription fees paid by you in the 12 months preceding the claim; or
    2. (b) INR 10,000.

    Nothing in these Terms limits GOQii's liability for:

    1. personal data breaches resulting from GOQii's failure to maintain reasonable security measures;
    2. death or personal injury caused by GOQii's negligence;
    3. any liability that cannot be excluded under the Consumer Protection Act 2019 or the DPDP Act 2023.

  • Suspension / Termination of Your Account

    GOQii may suspend or terminate your account at its sole discretion for any reason. If we suspect fraudulent, abusive or illegal activity, we may refer content or accounts to law enforcement authorities. Where you voluntarily close your account, we will:

    1. retain your personal data for 30 days during which you may request an export via privacy@goqii.com;
    2. permanently delete your account and personal data within 90 days following the 30-day grace period, subject to any legal retention obligations;
    3. stop syncing data from Apple Health and Google Health Connect immediately upon account closure.

    Health platform data already imported will be deleted within the 90-day window. Where GOQii terminates your account for breach of these Terms or fraud, the 30-day export window may not apply.

    For voluntary closure of accounts belonging to users under 18, parental or guardian confirmation may be required. Health platform connections (Apple Health, Google Fit) are disconnected immediately on account closure for minor accounts.


  • Cancellation and Return Policy

    You may return your GOQii device to the Company within 7 days of delivery by placing a "Cancel Order" request via the app or website. Returns will only be accepted for unused, unopened products with all original packaging.

    Subscription Cancellation: You may cancel your GOQii subscription at any time via Settings > Subscription > Cancel or by writing to renewals@goqii.com. Upon cancellation:

    1. Access to coaching services continues until the end of your current paid billing period;
    2. You will not be charged for the next billing cycle;
    3. For annual subscriptions cancelled within 30 days of the start date where no coaching sessions have been used, a pro-rata refund for the unused period (less a 10% administration fee) will be processed within 14 working days. After 30 days, no refund is payable for the remainder of the subscription term.

    Your personal data export remains available for 30 days after cancellation.

    Cancellation by parent or guardian: A parent or guardian of a user under 18 may cancel the subscription and request deletion of all associated personal data at any time by emailing renewals@goqii.com with proof of their relationship to the account holder. Refund eligibility follows the standard policy. Data deletion completed within 30 days (5 business days for COPPA/US requests).


  • Advertisement

    GOQii may display third-party advertisements and publicity materials on the Platform and via the Services. GOQii will not share your health data, medical history, Apple HealthKit data, Google Health Connect data, biometric data, or sensitive personal data with advertisers for targeting purposes. Any interest-based advertising using non-sensitive activity data will be subject to your consent preferences manageable via Settings > Privacy > Advertising. You may opt out of interest-based advertising at any time without affecting your access to the Services. Accounts identified as belonging to users under 18 have all advertising — including third-party advertisements — permanently disabled. This applies regardless of parental consent settings.


  • Your Privacy

    Your use of the Platform and Services is also subject to our Privacy Policy (goqii.com/privacypolicy), which is incorporated into these Terms by reference. However, your consent to the collection and processing of your personal data — particularly health data, sensitive personal data, Apple HealthKit data, and Google Health Connect data — is sought separately through the in-app consent mechanism at the point of registration and whenever new processing activities are introduced. Acceptance of these Terms does not by itself constitute consent to the processing of your personal data; such consent is obtained distinctly as required by the Digital Personal Data Protection Act 2023 and applicable data protection law.


  • Miscellaneous

    These Terms are governed by the laws of India, including the Information Technology Act 2000, the Digital Personal Data Protection Act 2023, and the Consumer Protection Act 2019, without regard to conflict of law provisions.

    For disputes arising under these Terms:

    1. We encourage you to first contact us at support@goqii.com to seek an informal resolution;
    2. If unresolved within 30 days, disputes may be referred to online dispute resolution (ODR) through the National Consumer Helpline portal (consumerhelpline.gov.in) or such ODR platform as GOQii designates;
    3. Where ODR does not resolve the matter, the courts of Mumbai, India shall have exclusive jurisdiction. Nothing in this clause prevents you from seeking relief from the Data Protection Board of India for data protection matters.

    If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.


  • Warranty

    GOQii Tracker (Device) is covered for all manufacturing defects for the duration of your subscription plan or 1 year, whichever ends earlier. To avail the warranty, raise a support ticket via the GOQii App. Warranty does not apply if you lose or damage your Tracker, and does not apply to the GOQii strap.

  • Severability

    If one or more of the provisions contained in this Agreement is held invalid, illegal or unenforceable in any respect by any court of competent jurisdiction, such holding will not impair the validity, legality, or enforceability of the remaining provisions.
